A una semana de su arresto, la exsecretaria de EducaciĆ³n, Julia Keleher, se declarĆ³ ayer no culpable de los siete cargos federales que pesan en su contra por su supuesta participaciĆ³n en un esquema de fraude en el Departamento de EducaciĆ³n (DE).
La exfuncionaria compareciĆ³ ante el magistrado Marcos LĆ³pez en el tribunal federal, quien le fijĆ³ una fianza de $30,000. El magistrado indicĆ³ que la mitad de esta cantidad serĆ” una fianza asegurada, mientras que la otra serĆ” no asegurada. Asimismo, como parte de los parĆ”metros de la fianza, Keleher solo podrĆ” viajar, segĆŗn decidiĆ³ LĆ³pez, a Washington, D. C., Maryland, Virginia, Puerto Rico y Pensilvania. De acuerdo con la abogada MarĆa DomĆnguez, representante legal de Keleher, este Ćŗltimo estado es donde residen los padres de la exfuncionaria.
Tras enfrentar un proceso inicial la semana pasada en Washington, D. C., Keleher llegĆ³ ayer cerca del mediodĆa a la isla.
De allĆ se trasladĆ³ a las instalaciones federales, a eso de las 2:00 p. m., donde un grupo de magisteriales la recibiĆ³ con una protesta, lo que requiriĆ³ que fuese escoltada por oficiales federales hasta la entrada del edificio.
Los manifestantes hicieron sentir allĆ mismo su descontento con la gestiĆ³n de Keleher como secretaria del DE, cargo que ocupĆ³ desde enero de 2017 hasta el 1.o de abril de 2019. Mientras intentaba entrar en las instalaciones federales, los manifestantes se acercaron a la exfuncionaria y le gritaron “pilla” y “corrupta” , entre otras cosas. A su entrada al tribunal, DomĆnguez indicĆ³ que no podĆa realizar expresiones debido a una orden de mordaza impuesta por el Tribunal Federal.
Durante la vista, el magistrado LĆ³pez enumerĆ³ los cargos por los cuales se le acusa a Keleher, que incluyen conspiraciĆ³n para cometer fraude electrĆ³nico, fraude electrĆ³nico y conspiraciĆ³n para cometer robo.
Por los cargos de fraude electrĆ³nico, la exfuncionaria enfrenta una pena mĆ”xima de 20 aƱos y una multa de no mĆ”s de $250,000. Mientras que por el delito de conspiraciĆ³n para cometer robo, el magistrado LĆ³pez indicĆ³ que se enfrenta a una pena mĆ”xima de 5 aƱos y una multa mĆ”xima de $250,000.
Mediante su abogada, Keleher se declarĆ³ no culpable de los siete cargos.
La fiscal federal Marie Christine Amy solicitĆ³ al juez que impusiera una fianza de $200,000 debido a la naturaleza de los cargos y los recursos econĆ³micos de la exfuncionaria. DomĆnguez objetĆ³ la peticiĆ³n y hasta solicitĆ³ que se mantuviera la determinaciĆ³n del magistrado en Washington, DC de que la extitular de EducaciĆ³n permaneciera en libertad bajo su propia responsabilidad.
SegĆŗn DomĆnguez, Keleher demostrĆ³ que “nunca ha intentado esconderse de las autoridades” y que no se trata de crĆmenes violentos ni obstrucciĆ³n a la justicia. La abogada, incluso, seƱalĆ³ que Keleher estĆ” desempleada.
Sin embargo, Amy reiterĆ³: “No estamos pidiendo detenciĆ³n; solo una cantidad razonable de fianza”.
El magistrado decidiĆ³ entonces fijar la cantidad de la fianza en $30,000 y estimĆ³ que el monto que solicitĆ³ la FiscalĆa era “excesivo”. AdemĆ”s, eximiĆ³ a Keleher de realizarse pruebas de sustancias controladas.
De acuerdo con el pliego acusatorio del Gran Jurado federal, Keleher participĆ³ en dos esquemas de fraude. El fraude en total —segĆŗn las autoridades federales— fue de $15 millones entre el DE y la AdministraciĆ³n de Seguros de Salud (ASES).
En el pliego tambiĆ©n figura como acusada Ćngela Ćvila, exdirectora de ASES; el expresidente de la empresa BDO, Fernando Scherrer; el exsubcontratista Alberto VelĆ”zquez PiƱol; Glenda Ponce, exasistente especial de Keleher, y su hermana Mayra, dueƱa de la empresa ColĆ³n & Ponce. Inclusive, ayer Ćvila y Scherrer acudieron a las instalaciones federales para culminar los procesos de fianza.
Como parte del forcejeo durante la llegada de Keleher, los oficiales federales arrestaron al manifestante Arnaldo Laboy. No obstante, su abogado, Diego AlcalĆ”, se limitĆ³ a seƱalar que se le radicaron unos cargos menos graves, pero no precisĆ³ cuĆ”les.
-A week after his arrest, former Secretary of Education, Julia Keleher, pleaded yesterday not guilty of the seven federal charges against him for his alleged involvement in a fraud scheme in the Department of Education (DE).
The former official appeared before Judge Marcos LĆ³pez in federal court, who set him a bond of $ 30,000. The magistrate indicated that half of this amount will be a secured bond, while the other will be unsecured. Likewise, as part of the bail bond parameters, Keleher may only travel, as LĆ³pez decided, to Washington, D.C., Maryland, Virginia, Puerto Rico and Pennsylvania. According to lawyer MarĆa DomĆnguez, legal representative of Keleher, the latter state is where the parents of the former official reside.
After facing an initial process last week in Washington, D.C., Keleher arrived yesterday at noon on the island.
From there he moved to federal facilities, at about 2:00 p.m. m., where a group of teachers received her with a protest, which required her to be escorted by federal officials to the entrance of the building.
The protesters made their dissatisfaction with Keleher's management as the secretary of the DE feel right there, a position he held from January 2017 to April 1, 2019. While trying to enter federal facilities, protesters approached the former official and they shouted "catches" and "corrupt", among other things. Upon entering the court, Dominguez said he could not make expressions due to a gag order imposed by the Federal Court.
During the hearing, Judge Lopez listed the charges for which Keleher is accused, including conspiracy to commit electronic fraud, electronic fraud and conspiracy to commit robbery.
For charges of electronic fraud, the former official faces a maximum penalty of 20 years and a fine of no more than $ 250,000. While for the crime of conspiracy to commit robbery, Judge Lopez said he faces a maximum penalty of 5 years and a maximum fine of $ 250,000.
Through his lawyer, Keleher pleaded not guilty to the seven charges.
Federal prosecutor Marie Christine Amy asked the judge to impose a bail of $ 200,000 due to the nature of the charges and the economic resources of the former official. Dominguez objected to the petition and even requested that the determination of the magistrate in Washington, DC that the former education director remain at his own risk be maintained.
According to Dominguez, Keleher showed that “he has never tried to hide from the authorities” and that it is not about violent crimes or obstruction of justice. The lawyer even pointed out that Keleher is unemployed.
However, Amy reiterated: “We are not asking for detention; just a reasonable amount of bail ”.
The magistrate then decided to set the amount of bail at $ 30,000 and estimated that the amount requested by the Prosecutor's Office was "excessive." In addition, he exempted Keleher from testing controlled substances.
According to the indictment of the federal Grand Jury, Keleher participated in two fraud schemes. The total fraud - according to federal authorities - was $ 15 million between the DE and the Health Insurance Administration (ASES).
The sheet also features as accused Ćngela Ćvila, former director of ASES; the former president of the company BDO, Fernando Scherrer; former subcontractor Alberto VelĆ”zquez PiƱol; Glenda Ponce, former special assistant of Keleher, and his sister Mayra, owner of the company ColĆ³n & Ponce. Even yesterday, Avila and Scherrer went to the federal facilities to complete the bail process.
As part of the struggle during Keleher's arrival, federal officials arrested the protester Arnaldo Laboy. However, his lawyer, Diego AlcalĆ”, merely pointed out that he was charged with less serious charges, but did not specify which ones.
